Terms of Use

1. Acceptance

By accessing or using ACCC NOW ("the platform"), you agree to be bound by these Terms of Use. If you do not agree, do not create an account or use the platform.

2. Eligibility

You must be at least 18 years old and legally able to enter into contracts. When you register on behalf of an organization, you confirm that you are authorized to bind that organization to these terms.

3. Accounts and security

• Provide accurate information and keep it up to date.
• Protect your credentials and any multi-factor devices.
• Notify us promptly of any unauthorized use of your account.
• You are responsible for activity that occurs under your account.

4. Acceptable use

You agree not to:

• Submit false, misleading, or fraudulent information or documents.
• Impersonate another person or organization.
• Circumvent access controls, attempt to access data belonging to other organizations, or probe the platform for vulnerabilities without written permission.
• Upload malware or content that is unlawful, infringing, or harmful.
• Use the platform to harass, threaten, or discriminate against others.

5. Organizations and roles

Owners and administrators control member access and the data associated with their organization. Members act on behalf of the organization within the permissions granted to them. Removing a member revokes their access to organization data going forward.

6. Applications and submissions

Information submitted through applications, questionnaires, and uploaded documents is retained for review, audit, and compliance purposes. You warrant that you have the right to submit the information you provide and that it is accurate.

7. Intellectual property

The platform, including its software, branding, and content, is owned by ACCC NOW or its licensors. You retain ownership of content you submit but grant ACCC NOW a limited licence to store, process, and display it as necessary to operate the platform.

8. Third-party services

The platform integrates with third-party services (for example, sign-in providers and infrastructure providers). Your use of those services is governed by their own terms and privacy policies.

9. Termination

You may close your account at any time. We may suspend or terminate access if you violate these terms or applicable law, or where continued access poses a risk to the platform or its users.

10. Disclaimers

The platform is provided "as is" without warranties of any kind. We do not warrant that the platform will be uninterrupted, error-free, or that the results obtained will meet your requirements.

11. Limitation of liability

To the maximum extent permitted by law, ACCC NOW and its affiliates shall not be liable for indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues.

12. Changes

We may update these terms from time to time. Material changes will be announced in the platform and may require you to re-accept before continuing.
